TERMS OF SALES

Preamble:


The general conditions of sale govern the contractual relations between any purchaser and Delphine LAIGNEL - ceramic sculptor - residing at 38 rue de la Roseraie, 76620 LE HAVRE (hereinafter referred to as "the artist").
These general conditions of sale are the only ones applicable and replace all other conditions, except prior, express and written exemption. We consider that by validating your order, you unreservedly accept these general conditions of sale after having read them.

1. PRICE
The sale prices indicated are in euros and all taxes included. Packaging costs are included in the price. Shipping costs are extra. Depending on the country, customs fees could be claimed by the customs administration, it is up to the purchaser to inquire and pay them.

2. PRODUCT INFORMATION
The photographs presenting the sculptures do not enter into the contractual field and cannot give rise to any commitment on the part of the artist. Each sculpture is a unique piece and could not be reproduced in the event of unavailability before confirmation of the order by the artist.


3. METHOD OF PAYMENT
Payment will be made by credit card or via Paypal.

The buyer's order will be shipped with the invoice


4. DELIVERY
Upon receipt of payment, the sculpture and the invoice will be packed in a suitable package and delivered to the transport company chosen by the artist. The sculpture will be sent to the address indicated on the order form within 5 working days. The purchaser will receive an e-mail specifying the tracking number of the delivery. The artist cannot be held responsible for the consequences due to a delay in delivery or a loss of packages on the part of the carrier.
Upon receipt of the order, the purchaser must verify the conformity of the item delivered and indicate, if applicable, on the delivery note and in the form of handwritten reservations accompanied by his signature, any anomaly. The purchaser must also confirm these reservations to Delphine LAIGNEL by email (delphinelaignelsculpture@gmail.com) the same day or at the latest one working day after receipt of his order. Any complaint made after this period cannot be accepted and will release the artist from any liability towards the purchaser.

The sculpture must be returned at its expense, duly packed.


5. RESPONSIBILITY
The artist cannot be held responsible for the breach of the contract concluded in the event of force majeure, disruption or total or partial strike, in particular postal services and means of transport or communications, flood, fire or of war. The artist will not incur any responsibility for any indirect damage, loss of business, loss of profit, damage or costs that may arise as a result of the purchase of any product. The artist cannot be held responsible for the consequences resulting from the bad handling of the acquired sculptures. The artist's liability will, in any event, be limited to the amount of the order.


6. COPYRIGHT, WORKS RIGHTS
French law considers that the author of a work of the mind enjoys over this work, by the sole fact of its creation, an exclusive intangible property right that can be enforced against all (article L.111.1 of the property code intellectual). The author enjoys in particular perpetual, inalienable and imprescriptible moral rights. It also enjoys representation and reproduction rights. The rights of the purchaser over the work are limited to private use, excluding any right of representation and reproduction, unless they obtain their prior consent.


7. DISPUTES
These present general conditions of sale are subject to French law. Any dispute, regardless of the place of delivery, which may result from the interpretation or execution of these conditions, will be submitted to the competent courts within the jurisdiction of the tribunal de grande instance of Le Havre.
